Hi,
A couple of questions on the simaltaneous filing of I-140 and I-485
1) I had read somewhere that USCIS was going to stop the same. Has that happened yet?
2) Say a person has applied for the I-140 but cannot simaltaneously apply for 485 due to retrogression. In the event that the dates become current BUT the I-140 is not yet approved, can the person still file for the 485 under the simultaneous filing or does he have to wait till the I-140 is actually approved?

Milind,
We did the same for both me and my spouse. I think we applied on Sept 5. I got mine within a week. Its been more than a month and we have not received my wife's SSN. We did call SSA on Sep 22 and they said everything was fine and we should receive it soon, If we do not receive by the end of the month go again to the local office. Have not received it yet, So plan to go to the SSN local office again tomorrow. My guess is it could have got lost in the transit.
Hope this helps.

I have valid H1B visa in my passport.
Can I travel to India via London.
Can you please tell me what restrictions we have at london to travel. I heard some European countries have restrictions to travel.
-------------------------
For transit flight through London (i.e. UK)
-------------------------
If a valid US visa is stamped in your passport and the passport and visa have not expired on the day of your travel, you are exempt from the transit visa requirement at London. If the visa is not stamped in you passport, say you are carrying advance parole travel document, in that case you need a Transit visa.
-------------------------
For transit flight through Paris (i.e. France)
-------------------------
If a valid US visa is stamped in your passport and the passport and visa have not expired on the day of your travel, you are exempt from the transit visa requirement at Paris. If you are carrying advance parole travel document, in that case too you do not need a Transit visa at Paris.
Hope this is useful.

Hi,
I have an H1, with a receipt date of April 2006. It was valid till July 2008. I came to US on that H1 in 2007 for 2 months. After that I have been working in India till March 2009.
Currently I am on H4. And there is a gap in employment since March 2009.
I have got an offer now and employer will take care of my H1.
I need to know what is the process of H4 to H1 in this case.? Can anybody help me
How much time does this change of status takes place?
The H1 now will be valid for how much time?
Will it depend on my husband's expiry date of H1. My husband's H1 is expiring in Sep 2010
Is it not recommended to move out of the country till status is changed from H4 to H1.
Please somebody reply. Its urgent!
Thanks in advance

Hi Guys,
I am also thinking abt applying for Canada PR?How much would it cost? Is location specific?
Again, looking at the website might help u more get the whole picture and all the details, than asking a question or two on forums http://www.cic.gc.ca/english/immigrate/index.asp
The cost varies by family size. For a family of 4, in the beginning u'll need 1000-2000 for application fees and to prepare ur documents. one or two years later, you'll need another 1000-2000 for medical exams and landing/visa fees.
If you apply to the federal program, you are allowed to go anywhere except quebec. There is also a provincial program in each province that allows u to immigrate to that province, but then again u can move later..

The US Citizenship and Immigration Service (USCIS) has issued new guidance (http://www.uscis.gov/files/nativedocuments/health_care_occupations_20may09.pdf)on the standards for adjudicating H-1B petitions filed on behalf of beneficiaries seeking employment in a health-care specialty occupation.
The memo suggests that adjudicators should first consult the U.S. Bureau of Labor Statistics Occupational Outlook Handbook (OOH) to determine whether the position qualifies as a H-1B "specialty occupation" as defined in the Immigration and Nationality Act.
The memo addresses licensing requirements for health-care workers in detail, and the effect of having a license - or not having a license - on approval of a case. If the foreign national has the required license, the adjudicator should not "look beyond the license." If the foreign national has a restricted license (e.g., license approved except for mandatory supervised practice), and the petition is otherwise approvable, an adjudicator should approve the petition for one year, or the duration of the restricted license, whichever is longer.
If the employee does not have the license because s/he needs certain immigration documents before getting a license, CIS can approved the petition for one year. The memo says that "The approval of any such H-1B petition shall not constitute approval by USCIS for the alien beneficiary to engage in any activity requiring possession of such State or local license. It is merely a means to facilitate the state or local licensing authoritys issuance of such a license to the alien, provided all other requirements are satisfied." Friends, here are my details:
EB3, India
PD: Feb 03
140/485 applied concurrently on July 23, 07 at TSC
140/485 Notice Date (from TSC): Sept 17, 07
Now, initially TSC had a processing time of 6 months for 140. They then changed it to a specific date later on. As of March 15, 08, it's about Aug 15, 07. Following the last few months' trend, my observation is that I might hear about my 140 sometime this month. However, it's just a guess - it might take longer.
When I call the USCIS (or even my attorney), I'm usually told that the dates on the site are just an estimate and even if my case is outside of the processing time according to their own web site, I can't speak with an immigration officer or do anything more about it. Is it true? I mean, say if I don't hear about my 140 this month at all and if the TSC processing time for 140 marches ahead well beyond Sept 17, 07 (my notice date), I can't even speak with an immigration officer?
Thank you.

Dear Friends,
We recently moved our place and we are now in a new apartment.
We have immigration matters that needs to be updated but we don't know what we should do?
The following are affected
1. EAD
2. H1B
3. AP
4. I 485 related things.
My Ead and Ap has old address and the card also holds the same old address.
Could you please tell me what steps I must initiate to get this straightened out? Do I need a new EAD card? Please help me.
Thanks a ton!
Just go to online address change and do it for all your petitions.
On another note, is it true that people are getting RFEs when they do address change? Has anyone faced this?
